University Education.

 

Mr Van Es read Law at the Rijksuniversiteit Leiden from September 1985 till June 1989 as a part-time student, first in weekends and after the first year, as an evening student. Then living in Amsterdam, Mr Van Es became interested in Dutch and European Alien Law, but maintained more affinity towards Family and Criminal Law.

 

From September 1974 till December 1977 Mr Van Es studied Medicine at The Erasmus Universiteit in Rotterdam. Mr Van Es made the switch to the Pharmaceutical Industry in The Netherlands, starting at Sandoz Netherlands and moving on to Smith Kline & French (now Glaxo-Smith Kline) ending his former career with Janssen Pharmaceutica Netherlands.

 

Mr Van Es also held a part-time laboratory job with the Central Laboratory of the Blood Transfusion Division of The Dutch Red Cross Organisation in Amsterdam. The medical education and subsequent extra-curricular experience in the Pharmaceuticals Industry became very useful in the Criminal Practice where DNA evidence in crimes, through the years became very prominent.

 

General and Family Law.

 

Dutch Family Law, including divorce, custody, alimony and minor representation (with juvenile delinquency cases next to the adult criminal cases), has been the primary basis of the practice. In The Netherlands, general Law subjects like rent issues, civil liability, estate matters and debt collection can easily pass through the practice of Mr Van Es.

 

From 1990 Mr Van Es has his practise in the South of The Netherlands, north of Eindhoven where he started in family law cases using methods of mediation first. Family battles leading up to divorce proceedings should never be aggravated by Mr Van Es, but sometimes Mr Van Es needs to be firm, tough and do what has to be done in the best interest of the children and the client. Should the other party choose for confrontational tactics, Mr Van Es will first try to lower the barriers by reminding that party (he or she) is an adult human being, be they are parents or not, and an emotional approach to the fore coming divorce is understandable, but should subside as soon as possible. It is not in the interest of the parties that their lawyers aggravate the damage already done to the relationship.

 

Islamic Family Law in The Netherlands.

 

Mr Van Es has knowledge of the “Mudawwana”, known as the Moroccan Family Law of February 5 2004, and is able to assist and advise those living in The Netherlands who have the need of an Islamic divorce. The Dutch courts can be requested to follow the Rules of Law as codified in The Mudawwana.

 

It is said that The Mudawwana can not only be followed for those of Moroccan origin, but also for other Muslim Countries and its citizens, except for Tunisian descendants. The principals of Islamic Family Law are to be found in The Mudawwana and are such that the majority of Muslim clients in The Netherlands, be they of other origin, will benefit from having a Dutch lawyer with knowledge of The Mudawwana. Mr Van Es grew up in the Far East as well as in the Middle East, especially in Bahrain.

 

Criminal law.

 

In Dutch Criminal Cases the percentage of acquittals is presently around 4%  while in the 1990ies it was about 6%. The Dutch Public Prosecutor has been helped by legislation to reduce that percentage. Dutch Criminal Lawyers nowadays have also - through jurisprudence and codification -  been confronted with the need of more argumentation / motivation in their pleas and motions. But . . . 80% of impossible is still possible!

 

Civil Litigation.

 

Mr Van Es is dedicated to the client’s case and will not proceed litigation without thorough consultation with the client, but is always ‘Dominus Litis’. Mr Van Es will get the client involved to solve the problem, for in his opinion the client will be able to come to terms with the problem sooner and thus benefit from her or his own input.

 

General obligations.


In The Netherlands a lawyer cannot take cases on the basis of “no cure no pay”.


Mr Van Es complies to all the rules and regulations of The Dutch Order of Advocates and to those set by the Local Order.


Mr Van Es does follow up-date law courses and study groups, for a Dutch lawyer is obliged to report yearly of law courses etc. to the Order.


Mr Van Es is also a certified Legal Aid Lawyer.


Mr Van Es has a "Third Party Money Foundation" for the receipt of client monies and is properly insured for his Law Practise, all according to the rules and regulations of the Dutch Order.


And last, Mr Van Es also has a complaint procedure according to the rules and the regulations stipulated by the Dutch Order.
