Tariffs:

For services, both procedural as advice, costs will be billed. The costs are to be distinct of fees, office costs, court costs, travel costs and costs due to services rendered by third parties (bailiffs due to serving summons subpoena's/ repossessions/confiscations and Lawyers outside the District of 's-Hertogenbosch as well as court roll observers, witnesses and experts and/or others) and also costs for legal dues of city registrars etc. Dependant on the sort of costs 19% V.A.T. (Value Added Tax = B.T.W.) may be due.

Fees:

The fee will be per hour, set according to individual financial capacity and will be given in writing with clients before services are rendered. Fees are subject to 19% V.A.T.

Office costs:
8% of fees are added for office costs. These are postage, telephone costs, telefax costs, e-mail costs, copies of paper evidence etc. and office paper etc. Office cost are subject to 19% V.A.T.

Travel costs:
Travel to appear in court and other necessary travel is billed separately, i.e. travel time and travelled kilometres. Travel time one way or back and inside 1 hour is 50% of the set hourly fee and per kilometre set at Euro 0.42. Travel time (one way/or back for more than 60 minutes) is set at 100% hourly fee. Travel costs are subject to 19% V.A.T.

Services rendered by third parties are subject to 19% V.A.T.

Legal dues to city registrars are usually exempt from 19% V.A.T.

Court costs, invoiced to the lawyer and payable to the court clerk by the lawyer, are exempt from 19% V.A.T.

Invoices:
In the legal branch it is custom to invoice in advance of rendering services, with either follow-up and end invoices.
In advance an attempt will be made to make an estimate of the time to render services with the necessary other costs. During services a follow-up invoice can be sent when the estimated time will be exceeded. The client will be asked to deliver any needed material him/herself as it is always a means to save costs.

Consultation:

By electronic mail or telephone it is usually possible to give a short provisional advice according to the then given information. Because of efficiency it is necessary to make an appointment in advance by telephone or email for telephone concultations, due to time differences. Appointments can be made in mutual agreement for after office hours, i.e. also in the evenings and in week-ends.

Personal meetings can be arranged in The Netherlands at any place such as Schiphol Airport or at your Hotel, Motel or Dutch Office. However I will have to invoice you first for such a meeting for travel costs and time reserved. You will be obliged to pay such costs in advance through electronic banking. Payment of such an invoice will have to be met, at least three bankingdays before the agreed appointment.

My services will be only subject to Dutch Law and rendered under and by the Rules and Regulations of and set by the Dutch Bar Association (N.O.V.A.). On the spot advice, given by telephone or immediate email contact, shall always have to be regarded as provisional advice based on the then given information. Outcome of your case will never be guaranteed nor can be foreseen without study of all relevant documents and information in direct phone call or immediate emails. If and when your case will be taken into consideration formally and agreement to commence representing you in The Netherlands has been formalised, liability claims shall always be referred to the care of my insurance company and be judged according to Dutch Civil Law and by a Dutch Court.

Office hours:

Workdays from 9:00 AM till 17:00 PM Central European Time.

Should  you hear the voice-mail, the office phone is usually routed to the mobile phone. This routing to the mobile phone is at the cost of the office. Please speak your name and especially your phone number in a short clear message. You will be contacted as soon as possible by Mr van Es.
